Adarky, A division of Speedus Corp, and Your Privacy Nothing is more important than your privacy.

Adarky services reflect commitment to user privacy. Today, users have a greater requirement for privacy online than ever before. Adarky has made user privacy a critical component of its product:

  • Adarky does not ask for your credit card number.
  • Adarky does not require your name.

User Data and Quality
Adarky is committed to continual improvement of your user experience and of quality of service for all users in the Adarky Network. We want you to know, however, that it may require the combining of data you submit when using your account with data generated from other Adarky services and maintenance activities. If there is any perceived risk to your privacy for certain associated services offered by Adarky, we will always give you the choice of opting out of providing information. Adarky servers automatically log data that your browser or the Adarky software sends whenever you visit a website or use Adarky. These logs may include information needed to assess quality and improve experience through understanding the cumulative effect of the interaction between your hardware type, web request, Internet Protocol address, browser type, browser language, the date and time of your request and MAC address. These may uniquely identify your equipment and reveal evolving problems and solutions for making Adarky work better for you.

User communications
When you send email or other communications to Adarky, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

Other Sites Adarky’s commitment to your privacy applies to all web sites and services owned and operated by Adarky.

Adarky only processes user data for the purposes described in this Privacy Policy. In addition to the above, such purposes include:

  • providing Adarky products and services to users, which may at some time include the display of customized content and advertising;
  • auditing, research and analysis in order to maintain, protect and improve Adarky services;
  • ensuring the technical functioning of Adarky’s network in creating a unique community of communities; and
  • researching and developing new services.

At this time, Adarky processes user data on servers in the United States of America. We may process user data to provide our own services. In some cases, we may process user data to assure the most appropriate match between advertisers and users.

User consent for disclosure of user data
When you sign up for Adarky services, we may ask you to provide certain data associated with your specific user-name account. If Adarky ever wants to use this data in a manner different than the purpose for which it was collected, Adarky will ask you for consent prior to such use.

If we propose to use user data for any purposes other than those described in this Policy, we will offer each user a clear way to opt out of such purposes. We will never utilize a user’s data for purposes other than those described in this Policy, unless we have obtained each user’s prior consent.

You can decline to submit user data to any of our services, in which case Adarky may not be able to provide you with those services.

Data sharing
Adarky will only share user data with others outside of Adarky if:

  • You have actively consented. We require opt-in consent for the sharing of any user data which might be considered sensitive.
  • User data is processed to improve Adarky services and processes. In such cases, Adarky may provide user data to Adarky subsidiaries, affiliated companies or other trusted businesses or suppliers for the this (Adarky requires affiliates and vendors to act in compliance with this policy and with other appropriate confidentiality measures for data safety).

We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service (http://www.Adarky.com/terms/) including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Adarky, its users or the public as required or permitted by law.

  • If Adarky becomes involved in a merger, acquisition or any other transaction resulting in a change of control of Adarky, we promise to provide notice before user data is transferred and becomes subject to a different privacy policy.
  • Adarky may share with third parties certain pieces of aggregated, non-personal data, such as the number of users who use a particular OS or router. Such information will never identify any user individually.

Safe Harbor Privacy Principles
In addition to Adarky’s own commitment to user privacy, Adarky adheres to the United States Safe Harbor Privacy Principles. These include proactive Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement policies. Adarky is registered with the U.S. Department of Commerce's safe harbor program http://www.export.gov/safeharbor/.

Information security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store specific user data.

We restrict access to user data to those Adarky employees, contractors and agents who require that data in order to operate, develop or improve Adarky services. These individuals, however, are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations. The same is true of outsiders who try to intrude and copy our user data for ANY REASON.

Data Integrity
Adarky processes user data only for the purposes for which Adarky collected it - and always in accordance with this policy.
Adarky reviews all data collection, storage and processing practices to ensure that we log, store and process only that user data which is needed to provide or improve services to users or to maintain the Adarky commitment to never charge its users or communities for services. Adarky takes reasonable steps to ensure that the user data we process is accurate, complete, and current.

Some of This Is Up To You
Adarky depends upon "Adarkists" to update or correct their personal information whenever appropriate. Adarky also depends upon the good sense of its valued users to never be casual or careless about revealing personal information to any person or entity not known by them to be responsible and trust-worthy.

This is really important — so important we should say it twice.

Accessing and updating your user data When you use Adarky services, we will always make good faith efforts to provide you with access to your own user data. This is so you can either correct user data if it is inaccurate, or delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes — or opt out of any other use of your user data.

We ask individual users to identify their user-name accounts and any user data requested for access, correction or deletion before processing such requests. We may decline to process requests that are:

  • unreasonably repetitive or systematic,
  • require disproportionate technical effort,
  • jeopardize the privacy of others, or
  • would be extremely impractical, or for which access is not otherwise required.

When we do provide information access and correction, we will perform this service for free - i.e., no money, checks, stamps, payment of any kind - except if doing so would require a disproportionate effort. (See above example.)

Changes to this policy
This Privacy Policy may change from time to time. (We’d sorta bet on it.) Adarky will never, however, reduce your rights under this policy without your explicit consent. We’re serious about this.

We will post any policy changes on this page and, if such changes are significant we will provide a more prominent notice.
Each version of this policy will be identified at the top of the page by its effective date. We will keep all prior versions of this Privacy Policy in an archive for your review.

Enforcement
Adarky regularly reviews its compliance with this policy. When we receive formal written complaints at this address, it is Adarky's policy to contact complainants to learn the gritty details and to ask for suggestions for improving our privacy policies and practices.

Adarky may be required by federal, state or local statute to cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of user data that cannot be resolved between Adarky and an individual. The same may be true in case of criminal investigations.
